The woman who left her husband for then-Supervisor Timothy E. Demler, triggering a chain of events that ended with Demler’s defeat in last year’s election, filed a lawsuit against the town Thursday.

In her complaint in State Supreme Court, town employee Tracy Gurnett charged that the situation “changed [her] work environment into an unsafe workplace, turning a job [she] loved into a job of constant stress, harassment and ridicule.”

She seeks an unspecified amount of monetary damages from the town, Supervisor Robert B. Cliffe, all the town councilmen and Town Attorney Robert O’Toole.

Gurnett had filed a notice of claim Feb. 15, and amended it Aug. 5. O’Toole said the matter was turned over to a defense attorney hired by the town’s insurance carrier, and Gurnett already had to testify in a closed hearing.

The lawsuit dates the alleged harassment back to May 29, 2009, the day The Buffalo News first revealed why the Niagara County Republican Committee revoked its endorsement of Demler for re- election.

It was because Michael Gurnett, Tracy’s husband and a Republican committeeman in the town, accused Demler of having an affair with Tracy.

Gurnett went up to Demler after a May 28 GOP meeting, brandishing a sealed envelope that turned out to contain photos of Tracy and Demler together in Jamestown.

The next week, the town Republican Committee overwhelmingly voted to unendorse Demler and gave its nod for supervisor to Town Justice Robert B. Cliffe.

Cliffe defeated Demler in the GOP primary last September and won the general election despite a record-setting number of write-in votes for Demler.

Tracy Gurnett, a clerk in the Building Inspection Department, said in her lawsuit that the May 29, 2009, edition of The News was “deliberately placed and/or allowed to remain in plain view, open to the page containing said article and left on a counter where customers or co-workers would see it.”

It said subsequent articles, including those from other newspapers, were similarly left out, along with printouts from Internet blogs. The suit said specifically that one printout was tacked to a town bulletin board Dec. 4.

All this, the lawsuit said, was “humiliating” to Gurnett.

At the first board meeting of the new administration Jan. 4, Gurnett’s job was cut from full-time to part-time. The suit calls this an unjust termination “based on her past lawful association with Tim Demler.”

However, O’Toole said Gurnett went back to full-time in the spring, after Chief Building Inspector Jennifer Caldwell resigned and was replaced by Joseph Caturia.

O’Toole, who was town human resources director at the time, noted that Demler was still in office then and could have done something about it.

Demler said, “The issue was, she had asked for assistance from the town attorney, who was human resources director at the time.”

Gurnett’s lawsuit lists her home address as Mapleton Road, at the same house Demler lists as his address. Demler confirmed the two are living together.

POLICE are hunting for thieves who stole a classic car identical to the one driven by TV detective Inspector Morse.

The maroon-coloured Mark II Jaguar — registration DKL 810C — is believed to have been driven to the Kingsteignton area.

It was taken from a farm in Buckfastleigh.

Devon and Cornwall Police said the Jaguar was parked in a barn but thieves forced entry to the building before getting in the car and pushing it down a lane to the road.

A recovery vehicle was waiting, which took the car to the Kingsteignton area, and it has not been seen since.

A force spokesman said the theft took place between August 21 and 28.

Police are appealing for anyone who may have been approached and offered the car or who has any information to contact police on 08452 777444 or Crimestoppers anonymously on 0800 555111.

The value of the car is not known.
